A “deposit account” means any personal or professional control, money market, savings, individual retirement or deposit account certificate that you can maintain with us at any time and from time to time. They agree to register the original cheque safely for a period of eighty-one (91) calendar days from the date the image is transmitted (this period is the “preservation period”). During the retention period, you take appropriate security measures to ensure (a) that only authorized persons have access to original controls, (b) the information contained in these controls is not disclosed; c) these controls are not reproduced or scanned more than once and (d) these controls are not filed or negotiated in any form. During the shelf life, you agree to immediately make the original cheque available to the Bank upon request (but in all cases within 5 business days). The risk of loss due to the original unavailability or a copy of a cheque for any reason during the retention period is entirely within your purview. If the report is oral, we may request that you send the complaint or question in writing within 10 (10) working days. We will determine if an error occurred within 10 business days of your error and we will immediately correct any errors. However, if you need more time, it will take us up to forty-five (45) days to consider a complaint or issue. In this case, we will credit your account within 10 (10) working days of the amount you deem to be defective. This allows you to use the money during the time it took us to complete our investigation. If we ask you to submit your complaint or question in writing and we do not receive it within 10 business days, we cannot credit your account.
